Donation Limits and Disclosure
  • Individual Donations: There is no upper limit to non-anonymous donations, but specific rules apply to the disclosure of donor identities:
    • Donations under $1,500 can be kept anonymous by the receiving party or candidate.
    • Donations over $1,500 require the donor to be identified in annual returns if the total from that donor in a calendar year exceeds $5,000.
  • Anonymous Donations:
    • Anonymous donations are limited to a maximum of $1,500 per donor per calendar year. Parties cannot retain anonymous donations exceeding this amount unless they are processed through the Electoral Commission's "donation protected from disclosure" system.
  • Donations Protected from Disclosure:
    • For individuals or organizations wishing to donate more than $1,500 anonymously, they can donate through the Electoral Commission. This system allows for donations up to $56,028 to any one political party between two successive elections, without disclosing donor identity to the party. This mechanism ensures compliance while protecting donor anonymity.
  • Foreign Donations:
    • Political parties can only accept up to $50 from individuals or entities who are not New Zealand citizens or registered electors. Any excess must be returned or forwarded to the Electoral Commission within 20 working days.
Reporting and Compliance
  • Annual Returns:
    • Political parties must submit annual returns detailing all donations and loans over $1,500 by April 30 each year. This includes the name and address of donors for donations exceeding $5,000.
  • Immediate Reporting:
    • During an election year, any donation over $20,000 received between January 1 and the day before the election must be reported to the Electoral Commission within 10 working days.
  • Record Keeping:
    • Parties are required to maintain accurate records of all donations and loans, including those below the reporting thresholds, to ensure they can comply with disclosure obligations if required.
Compliance and Enforcement
  • Penalties for Non-Compliance:
    • Falsifying donation reports or failing to report can lead to significant penalties under the Electoral Act, including fines. There's also an offence for not transmitting a donation to the intended recipient.
